To become an advocate in India, a law graduate has to pass the All India Bar Examination (AIBE). According to the AIBE eligibility criteria, a candidate has to be enrolled with a state bar council before appearing for the AIBE exam. After clearing AIBE, the candidate will be issued a Certificate of Practice (COP). It should be noted that the AIBE exam is mandatory for candidates who pursued their law degree from 2009-10 onwards.
The AIBE is a post-enrolment exam. This means any candidates who want to practice law in Uttar Pradesh need to fill out the registration form for the Bar Council of Uttar Pradesh and enrol with it before appearing for the AIBE exam. The provisional enrolment is valid for two years on an undertaking that the candidate will pass the exam within 2 years of the date of enrollment.

The Bar Council of India stated that the right to practice would be valid only for two years under a provisional enrolment. However, the candidates can continue to appear for the All India Bar Examination as many times after the provisional enrolment. The result, therefore, is that any candidate who is provisionally enrolled is allowed to appear for the AIBE exam not just for two years beyond but for any number of times till he or she passes the exam. The date of reckoning seniority would be considered from the date of the provisional enrolment.
